Cookies

The webpages of WorkGenius GmbH use cookies. These are text files that are stored on a computer system via an internet browser.

Many websites and servers use cookies. Many cookies contain a so-called cookie ID, which is a unique identifier of the cookie. It consists of a string of characters through which internet pages and servers can be assigned to the specific browser in which the cookie was stored. This enables the visited pages and servers to distinguish the individual browser of the person concerned from other internet browsers that contain other cookies. A particular internet browser can be recognized and identified by its unique cookie ID.

Using cookies, WorkGenius GmbH can provide users of this website with more user-friendly services that would not be possible without them.

By means of a cookie, both the information and the offers on our website can be optimized in the interests of the user. As mentioned, cookies enable us to recognize the users of our website. The purpose of this recognition is to make it easier for users to navigate our website. For example, users of a website that use cookies do not have to re-enter their access data each time they visit the website because this is taken over by the latter, so the cookie is stored on the user's computer system. Another example is the cookie of a shopping basket in an online shop. The online shop remembers the items that a customer has placed in the virtual shopping basket via a cookie.

The person concerned can prevent the setting of cookies by our website at any time by configuring their browser accordingly; thus, permanently objecting to the use of cookies. Furthermore, cookies that have already been used can be deleted at any time via an internet browser or other software programs. This is possible in all common internet browsers. If the person concerned deactivates the use of cookies in the internet browser used, not all functions of our website may be fully usable.

Collection of general data and information

The WorkGenius GmbH website collects a range of general data and information each time it is accessed by a data subject or an automated system. This general data and information are stored in the log files of the server. The (1) browser types and versions used can be recorded, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-sites which are accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet protocol address (IP address), (7) the internet service provider of the accessing system and (8) other similar data and information used to avert dangers in the event of attacks on our information technology systems.

When using this general data and information, WorkGenius GmbH does not draw any conclusions about the person concerned. Rather, this information is required to (1) correctly deliver the content of our website, (2) optimize and advertise its content, (3) ensure the long-term operability of our information technology systems and the technology of our website and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber-attack. Therefore, anonymously collected data and information are evaluated by WorkGenius GmbH both statistically and with the aim of increasing data protection and data security in our company, ultimately ensuring an optimum level of protection for the personal data processed by us. The anonymous data of the server log files are stored separately from all personal data provided by the person concerned.

Disclosure of data

As part of the further development of our business, the structure of WorkGenius GmbH may change as the legal form changes, subsidiaries, parts of companies or components are founded, purchased or sold. In such transactions, customer information is shared along with the part of the company to be transferred. Whenever Softgarden transfers personal data to third parties to the extent required by law, ensures that this is done in accordance with this privacy policy and the relevant data protection laws.

Data collection within the scope of the use of the software

When registering, personal data and company information are entered on the website. This is only collected, stored and processed by WorkGenius to the extent necessary for the provision of services in accordance with the contract and/or permitted by statutory provisions, or as required by law.

Signing up to our newsletter

Users are given the opportunity to subscribe to our company newsletter on the WorkGenius GmbH website. The personal data transmitted to the data controller when subscribing the newsletter is determined by the input mask used for this purpose.

WorkGenius GmbH informs its customers and business partners at regular intervals by means of a newsletter on what the company has to offer. It can only be received by the person concerned if (1) they have a valid e-mail address and (2) if they registered to receive the newsletter. For legal reasons, a confirmation e-mail in the double opt-in procedure will be sent to the e-mail address entered for the first time by the person concerned for the purpose of sending the newsletter. This confirmation e-mail is used to check whether the owner of the e-mail address as the person concerned has authorized receipt of the newsletter.

On subscribing to the newsletter, we also store the IP address assigned by the Internet Service Provider (ISP) to the computer system used by the person concerned at the time of registration as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of the e-mail address of a person concerned at a later point in time. Therefore, it serves to legally safeguard the data controller.

The personal data collected as part of a newsletter registration will only be used to send out our newsletter. Subscribers to the newsletter may be informed by e-mail if this is necessary for the operation of the newsletter service or registration, as might be the case in the event of changes to the newsletter or changes to the technical conditions. The personal data collected as part of the newsletter service will not be passed on to third parties. The subscription to our newsletter can be cancelled by the person concerned at any time. The consent to the storage of personal data, which the person concerned has given us for the newsletter send-out, can be revoked at any time. For the purpose of the revocation of the consent, there is a corresponding link in every newsletter.

Newsletter Tracking

The WorkGenius GmbH newsletter contains so-called tracking pixels. These are a miniature graphic embedded in e-mails sent in HTML format to enable log file recording and analysis. This allows statistical evaluation of the performance of online marketing campaigns. Using the embedded tracking pixels, WorkGenius GmbH can identify whether and when an e-mail was opened by a person and which links in the e-mail were accessed by the them.

Such personal data collected via the tracking pixels contained in the newsletters is stored and evaluated by the data controller in order to optimize the newsletter dispatch and to adapt the content of future newsletters even better to the interests of the person concerned. This personal data will not be passed on to third parties. Affected persons are entitled at any time to revoke the relevant separate declaration of consent submitted via the double opt-in procedure. After a revocation, this personal data will be deleted by the person responsible for the processing. If you unsubscribe from the newsletter, WorkGenius GmbH automatically interprets this as a revocation.

Contact via the website

Due to legal regulations, the WorkGenius GmbH website contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the data controller by e-mail or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted voluntarily by a data subject to the data controller will be stored for the purposes of processing or contacting the data subject. This personal data will not be passed on to third parties.

Routine deletion and blocking of personal data

The controller shall process and store the personal data of the data subject only for the period necessary to achieve the storage purpose or where provided for by the European directive and regulation maker or another legislator in laws or regulations to which the controller is subject.

If the storage purpose no longer applies or if a storage period prescribed by the European directives and regulators or another competent legislator expires, the personal data shall be blocked or deleted routinely and in accordance with the statutory provisions.

Data protection for applications and in the application process

Data stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude a contract of employment with the applicant, the application documents shall be automatically deleted two months after notification of the rejection decision, unless deletion conflicts with any other legitimate interests of the controller. Other legitimate interests in this sense include, for example, the duty to provide evidence in proceedings under the General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz - AGG).

Privacy policy for use and application of affilinet

The data controller has integrated components of the affilinet company on this website. Affilinet is a German affiliate network that operates in affiliate marketing.

Affiliate marketing is an internet-supported sales form that enables commercial operators of internet sites, the so-called merchants or advertisers, to display advertisements that are usually paid by click or sale commission, on internet sites of third parties, i.e. sales partners who are also called affiliates or publishers. The merchant provides an advertising medium via the affiliate network, i.e. an advertising banner or other suitable means of internet advertising, which is subsequently integrated by an affiliate on its own webpage or advertised via other channels, such as keyword advertising or e-mail marketing.

The operating company of Affilinet is affilinet GmbH, Sapporobogen 6-8, 80637 Munich, Germany.

Affilinet places a cookie on the information technology system of the person concerned. The definition of cookies has already been explained above. Affilinet's cookie-tracking does not store any personal data. Only the affiliate's identification number, i.e. the partner referring the potential customer, as well as the visitor's serial number on a website and the advertising medium clicked on are stored. The purpose of storing this data is to process commission payments between a merchant and the affiliate, which are processed via the affiliate network, i.e. Affilinet.

The person concerned can prevent the use of cookies by our website at any time, as described above, by configuring the internet browser used, thus permanently objecting to the use of cookies. Such a setting of the internet browser used would also prevent Affilinet from setting a cookie on the information technology system of the person concerned. In addition, cookies already used by Affilinet can be deleted at any time via an internet browser or other software programs.

Affilinet's current data protection regulations can be found at https://www.affili.net/de/footeritem/datenschutz.

Privacy policy on the use and application of Facebook

The data controller has integrated Facebook components on this website. The latter is a social network.

A social network is an internet-based social meeting place, an online community that usually enables users to communicate with each other and interact in a virtual space. A social network can serve as a platform for the exchange of opinions and experiences, but it also enables the internet community to provide personal or company-related information. Facebook enables users of the social network to create private profiles, upload photos and network via friend requests.

The operating company of Facebook is Facebook, Inc. 1 Hacker Way, Menlo Park, CA 94025, USA. If a data subject lives outside the USA or Canada, the person responsible for processing personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time one of the individual pages of this website is accessed, which is operated by the data controller and on which a Facebook component (Facebook plug-in) has been integrated, the internet browser on the information technology system of the person concerned is automatically prompted by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be found under https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical process, Facebook obtains information on which specific subpage of our website is visited by the person concerned.

If the person concerned is logged into Facebook at the same time, Facebook recognizes which specific page of our website the person concerned is visiting each time they visit our website and for the entire duration of their stay on our website. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the person concerned. If the person concerned clicks one of the Facebook buttons integrated on our website, for example, the "Like" button, or if the person concerned makes a comment, Facebook assigns this information to the personal Facebook user account of the person concerned and stores this personal data.

Facebook receives information through the Facebook component that the individual concerned has visited our website whenever the individual concerned is logged into Facebook at the same time as accessing our website, regardless of whether the individual concerned clicks on the Facebook component or not. If the data subject does not want this information to be transferred to Facebook in this way, he or she can prevent the transfer by logging out of his or her Facebook account before accessing our website.

Facebook's published data policy, which is available at https://de-de.facebook.com/about/privacy/, provides information about the collection, processing and use of personal data by Facebook. It also explains which settings Facebook offers to protect the privacy of the person concerned. In addition, various applications are available that make it possible to suppress data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.

A so-called embedding code is used for embedding. An embedding code is an HTML code that is integrated into a website by a website operator. If an embed code has been integrated by a website operator, the external content of the other website is displayed by default as soon as a website is visited. To display the external content, the external content is loaded directly from the other website. Getty Images provides more information about embedding content at http://www.gettyimages.de/resources/embed

Through the technical implementation of the embed code that enables Getty Images to display images, the IP address of the internet connection through which the individual accesses our site is transferred to Getty Images. Getty Images also collects information about our website, the type of browser used, browser language, time and length of access. In addition, Getty Images may collect navigation information, which is information about which of our sub-pages the individual visited, and which links the individual clicked, as well as other interactions the individual performed when visiting our site. This information may be stored and used by Getty Images.

For more information and to review Getty Images' privacy policy, please visit https://www.gettyimages.de/company/privacy-policy.

In addition, a cookie already used by Alphabet Inc. can be deleted at any time via the internet browser or other software programs.

Google AdSense also uses so-called tracking pixels. These are a miniature graphic embedded in e-mails sent in HTML format to enable log file recording and analysis. This allows statistical evaluation of the performance of online marketing campaigns. Using the embedded tracking pixels, Alphabet Inc. can identify whether and when an e-mail was opened by a person and which links in the e-mail were accessed by the them. Tracking pixels serve among other things to evaluate the visitor flow of a website.

This personal data is stored by Google in the United States of America. Google may share this personal data collected through the technical process with third parties.

The person concerned can prevent the use of cookies by our website at any time, as described above, by configuring the internet browser used, thus permanently objecting to the use of cookies. Such a setting of the internet browser used would also prevent Google from using a cookie on the information technology system of the person concerned. Legal basis for the processing

Art. 6 of the GDPR serves our company as a legal basis for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of other services or consideration, the processing is based on Art. 6 of the GDPR. The same shall apply to such processing operations which are necessary for the implementation of pre-contractual measures, for example in cases of inquiries regarding our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as for the fulfilment of tax obligations, the processing is based on Art. 6 of the GDPR. In rare cases, the processing of personal data may become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor to our site were injured and their name, age, health insurance information or other vital information would have to be disclosed to a doctor, hospital, or other third party. In this case, the processing would be based on Art. 6 of the GDPR. Processing operations that are not covered by any of the aforementioned legal basis rest upon this legal basis if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and fundamental freedoms of the data subject do not predominate. We are allowed such processing operations because they have been specifically mentioned by European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the data controller (47th recital, 2nd sentence of the GDPR).

Legitimate interests in the processing pursued by the controller or by a third party

If the processing of personal data is based on Article 6 of the GDPR, then our legitimate interest is the conduct of our business for the benefit of all our employees and shareholders.
